Accelerate is operated by Accelerate Now. In these terms, "Accelerate," "we," "us," and "our" refer to the operator of the Accelerate service. "Customer," "you," and "your" refer to the person or organization using the service.

The rules for using Accelerate.
These terms explain how Accelerate works, what you can expect from us, and what we expect from users of the platform.

Acceptance of terms
By accessing or using Accelerate, you agree to these Terms of Service. If you do not agree, do not use the platform. These terms apply to all users, including agencies, businesses, team members, and visitors to our public website.
Description of service
Accelerate is an AI-powered enquiry assistant SaaS. Agencies and businesses can create AI chatbot agents, configure prompts and knowledge sources, deploy website widgets, connect supported messaging channels, and capture visitor enquiries. We may add, update, limit, suspend, or remove features over time for product, security, legal, or operational reasons.
User accounts
You are responsible for maintaining the security of your account, login credentials, and workspace access. You agree to provide accurate information and keep it current. You are responsible for all activity under your account unless caused by our own fault. You must not share credentials or allow unauthorised access to your workspace.
Acceptable use
You may not use Accelerate for unlawful, abusive, deceptive, harmful, or infringing activity. This includes spam, fraud, malware, prohibited adult content, harassment, privacy violations, scraping without permission, impersonation, misleading claims, or using the service to generate or distribute illegal content. You must not probe, scan, overload, reverse-engineer, bypass limits, resell access without permission, or interfere with the platform or its infrastructure. We may suspend or terminate accounts that violate these rules without prior notice.
Customer websites and visitor notices
If you install an Accelerate widget or connect a messaging channel, you are responsible for your own website notices, consent flows, privacy policy, cookie disclosures, and lawful basis for collecting visitor conversations and leads. You must clearly disclose when appropriate that visitors are interacting with an AI assistant and that their messages may be processed by Accelerate and third-party AI providers.
AI-generated content disclaimer
Accelerate uses third-party AI models to generate responses on behalf of your agents. AI-generated responses may contain errors, omissions, outdated information, or inaccurate statements. AI output does not constitute professional, legal, medical, financial, tax, safety, or emergency advice. You are responsible for configuring, testing, supervising, and monitoring your agents and for deciding whether human review is required before messages reach end users. Accelerate does not guarantee the accuracy, completeness, legality, or fitness of any AI-generated output for any particular purpose.
Intellectual property
We retain all rights in Accelerate, including the software, branding, design, and underlying platform. You retain ownership of your own uploaded content, prompts, workspace data, and customer data, subject to the rights needed for us to operate the service on your behalf. You grant us a limited, non-exclusive, worldwide licence to use, process, store, and display your content solely for the purpose of providing the service.
Indemnification
You agree to indemnify, defend, and hold harmless Accelerate Now, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of Accelerate; (b) your violation of these terms; (c) your violation of any third-party rights; (d) the content, prompts, or data you upload or configure; or (e) the actions or responses of AI agents you create and deploy.
Disclaimer of warranties
Accelerate is provided on an "as-is" and "as-available" basis without warranties of any kind, whether express, implied, statutory, or otherwise. We expressly disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the service will be uninterrupted, error-free, secure, or free of harmful components. We do not warrant that AI-generated responses will be accurate, complete, or suitable for any particular purpose.
Billing and subscriptions
All prices on Accelerate are listed and charged in United States Dollars (USD) unless checkout states otherwise. Subscriptions are billed monthly and automatically renew unless cancelled. Paid plans may begin with a 14-day Paddle trial. You may be asked to provide payment details at checkout, but you will not be charged until the trial ends unless checkout states otherwise. You can cancel your subscription from Settings > Billing or the Paddle customer portal. Payment processing, tax calculation, invoices, receipts, and card handling are provided by Paddle. By subscribing, you also agree to Paddle's checkout terms and payment terms. Applicable taxes may be calculated and added at checkout. If payment fails, we or Paddle may retry the charge and we may limit, suspend, or terminate access after a reasonable grace period.
Limitation of liability
To the maximum extent permitted by law, Accelerate Now is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, lost data, business interruption, reputational harm, or cost of substitute services, however caused and regardless of theory of liability. Our total aggregate liability for all claims relating to the service will not exceed the amounts you actually paid us in the twelve (12) months immediately preceding the event giving rise to the claim, or fifty US dollars (USD $50), whichever is greater.
Service availability and uptime
We strive to maintain high availability but do not guarantee any specific uptime percentage. The service may be temporarily unavailable due to maintenance, updates, third-party provider outages, or circumstances beyond our control. We are not liable for any downtime or service interruptions.
Force majeure
Neither party will be liable for failure or delay in performance caused by events beyond reasonable control, including natural disasters, pandemics, wars, terrorism, government actions, power failures, internet disruptions, or third-party service provider outages.
Termination
You may stop using the service at any time. We may suspend or terminate access immediately and without notice if you breach these terms, misuse the service, pose a security or compliance risk, or fail to pay applicable fees. We may also remove or disable content where required for safety, legal, or operational reasons. Upon termination, your right to use the service ceases immediately. Provisions that by their nature should survive termination (including indemnification, limitation of liability, and disclaimers) will survive.
Dispute resolution
Before initiating any formal dispute, you agree to first contact us at support@acceleratenow.app and attempt to resolve the matter informally within thirty (30) days. You agree that any dispute that cannot be resolved informally will be resolved on an individual basis. You waive the right to participate in any class action, collective action, or representative proceeding against us.
Governing law
These terms are governed by the laws of Fiji, except where mandatory consumer protection or data protection law in your location requires otherwise. Any dispute arising out of or relating to the service or these terms will be handled by the courts of Fiji unless applicable law requires a different forum.
Severability
If any provision of these terms is held invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
Entire agreement
These Terms of Service, together with our Privacy Policy, Refund Policy, Security page, Subprocessors page, and any applicable Data Processing Addendum, constitute the entire agreement between you and Accelerate Now regarding your use of Accelerate. They supersede any prior agreements or understandings, whether written or oral.
Changes to terms
We may update these terms from time to time. When we do, we will post the updated version on this page and update the effective date. Material changes will be communicated through the platform or by email where practical. Continued use of the service after changes take effect means you accept the updated terms.
